Student's "allergic reaction" to restaurant--a lawsuit!
Christopher Puccio visited an Applebee’s in West Virginia, and warned that he was extremely allergic to fish. Allegedly, the restaurant’s staff ignored his warning and failed to clean its grill before preparing his food. He experienced a severe allergic reaction and is now suing the restaurant.
As the West Virginia Record reports,
Puccio went to Applebee’s on Nov. 5, 2005, to order food with friends.
“As he ordered his food he informed the server of a severe allergy to seafood and was assured his food would be prepared without contact with seafood,” the suit says.
Puccio claims he previously had suffered a reaction at the restaurant in March 2005 and was concerned for his safety.
However, the suit states Puccio’s food was not prepared on a clean grill, which allowed it to be exposed to seafood.
Because of the negligence shown in preparing his food, Puccio became violently ill and was transported to the emergency room for lifesaving procedures, the suit says.
Puccio claims he suffered serious injury and damages, pain and physical disability, mental anguish and great discomfort of the body. He will suffer severe impairment to and loss of enjoyment of life in the future and may require future medical treatment.
According to the suit, Puccio is informed that his injuries will result in some permanent disability. He was lost considerable personal time and delayed his ability to return to school.
Through attorney J. Steven Hunter, Puccio seeks general damages, medical and related expenses, and other costs.

something similar just happened to me, but at a Brann’s in Michigan. They fried mozzarella cheese sticks in the same oil as their shrimp & other fish/seafood. They did not have a warning posted regarding so. When I contacted the store location the manager acted like it was no big deal & that their policy was to fry everything together. He also said he had been there for 10 years and never had such a complaint. I contacted the corportate office looking for medical reimbursement and they told me no. Offered me an 8 oz steak girf certificate and said “If I am that allergic, I should ask”. I am considering contacting a lawyer, but not sure if I have a case.

Well I can say first hand, considering I am the Chris in the story, that they will drag it out as long as they can to discourage you from continuing on with the lawsuit
